Thank you for sharing the photos with us, I am about to start one of these, and this will help me greatly, and as far as it being a disservice to the author and publisher of the book it came out of, for one its only a few pages, and lets all think where all the reference photos come from on the net,. most are posted by other people taken out of books and magazines, and copies from other sites. I can’t speak for the majority of the sites or authors but there was no harm done in my opinion, its not like Manstein’s revenge intended to put anybody out of work. I have bought my share of books for reference and they are not cheap, in fact before i buy I try to find it on the net, (for free) or the library. P.S. I am not wanting to start any drama on the site just my opinion.

MR: Actually, I DID say that an M4A1 with HVSS in a wartime setting is one of the Holy Grail pics. Your memory is better than mine.

The Fair Use concept in relation to Copyright of printed material, including photographs, actually has a very narrow interpretation when it comes to the “educational” or “discussion purposes” application. Most books have a little blurb in their front covers where it says something along the lines of this such as can be found in some of the Concord publications I have: “All rights reserved. No part of this publication may be reproduced, stored in a retrieval system or transmitted in any form or by any means, electronic, mechanical, photocopying, or otherwise, without the prior written permission of Concord Publishing Co.”. Others aren’t as far reaching but the protection of the rights is usually along the same lines.

As a general rule, so long as the publication/author are credited as the source of the photos and the photos are posted explicitly for discussion purposes only and are of a low resolution and do not represent entire pages or series of pages, you can generally get away with it under the “Fair Use” application. Just posting up photos and/or taking entire pages verbatim and scanning them in and sharing them with the public at large is generally considered a copyright violation because you are now “reproducing and distributing” copyrighted material. Granted the copyright owner has to bear the burden of enforcement/protection of their copyright but it still doesn’t change the fact that the activity is a copyright violation.

The rise of the Internet and the free flow and exchange of material and ideas has given rise to much tighter wording on the copyright/rights reserved clauses. It’s also a reason why book prices have risen…because of piracy and decreased market share that produces due to people willing and able to distribute copyrighted material for “free” because they don’t see any harm in doing that.

It’s one thing IMHO to post up and credit photos to a source/author as part of a discussion. It’s quite another to try and create a “free source” of such material either in individual threads that ends up distributing or replicating material that is protected and by rights belongs to the author/publisher.

It’s worth noting that these forums are hosted by Kalmbach Publishing and if copyrighted material is posted here on their forums and allowed to remain and be searched in their archives, there’s potential legal liability issues that they would face along with the original poster who put the material up. [;)]

I’m not looking to be the internet police or anything similar…but people often have a very squishy idea of what copyright law means and is all about. The Internet fosters this in a lot of ways and sometimes the copyright holder will pursue their rights and sometimes not…so you pays your money and you takes your chances. Kind of like speeding…everybody does it but that doesn’t stop the police from putting out speed traps from time to time and making money off the tickets and enforcing the law when it’s worthwhile to do so.

For the curious, this is the latest standard updated in 2006 regarding the “Fair Use” doctrine as viewed by the US Copyright Office: http://www.copyright.gov/fls/fl102.html . Forums generally can get away under the “comment” provision but there actually has to be comment/discussion for that to be applicable. Some, like Missing-Lynx, also are able to get away with it under the scholarship/research component. Teaching/educational use required there to be students and teachers in a formal educational setting (I know having been a former public school teacher and college instructor) but even that has limits. You can’t fully replicate something for educational use for example like photocopying an entire book and distributing it to your students.

Posting up copyrighted photos for the purpose of distribution/sharing them with a community without corresponding discussion/comment or scholarship/research taking place is a clear copyright violation…just like deciding to go 75 in a 55 mph zone is breaking the traffic safe speed law. Will you be caught and punished? It depends on whether there’s a cop hiding under that overpass or not. [;)] Copyright cases can and do result in civil fines and penalties much higher than anything a speeding ticket will generate though…all depends on how aggressive the copyright holder is in pursuing legal action and defending their rights.

In the spirit of discussion…that final pic is neat in terms of the clock face on the inside of the MG shield…that’s the first time I can recall seeing that. Maybe the gunner had a hard time keeping track of where his 3 o’clock was? [(-D]

Did 250/9’s have zimmerit that was field-applied?..did Shermans have zimmerit after they were captured by the Germans…if so, was it filed-applied? Please converse and discuss…
